Article 19 – Restriction of Fundamental Rights – Legal Protection

(1) Insofar as, under this Basic Law, a fundamental right may be restricted by or pursuant to a law, such law must apply generally and not merely to a single case. Moreover, the law must specify the fundamental right and cite the relevant Article.

 

(2) In no case may the essence of a fundamental right be affected.

 

(3) The fundamental rights shall also apply to domestic legal persons to the extent that the nature of such rights permits.

 

(4) If any person’s rights are violated by public authority, they shall have recourse to the courts. Unless another jurisdiction is established, recourse shall be to the ordinary courts. Article 10 paragraph (2) sentence 2 shall remain unaffected.
